Partner visas in Western Australia
What's different in WA.
No relationship register in WA
Western Australia has no relationship register, so couples in Perth cannot register their way around the 12-month rule. A de facto partner visa needs 12 months of living together before you apply, unless compelling and compassionate circumstances apply, such as having a child together.
Married couples are not affected. If you are close to 12 months, we plan the lodgement date with you so the application is not lodged early.
Supporting statements
Friends and family who know you as a couple complete Form 888. Since July 2023 it is a supporting statement, not a statutory declaration, so it does not need a JP or any other witness. Each person must be 18 or over and attach proof of identity.
If you also need a Commonwealth statutory declaration, the national witness list applies. In Perth you can find a JP through the WA Government.
Only one of you on the lease? We show the shared household another way: bond records, utility accounts, the agent's correspondence and mail to the same address.
Employer visas in Perth
Perth is regional.
Perth is a Category 2 regional area, so Perth businesses can use the regional employer visa that Sydney, Melbourne and Brisbane businesses cannot.
Roles in Perth
- Skills in Demand (482): salary at least the Core Skills Income Threshold (CSIT) and the market rate
- Employer Nomination (186): permanent residence, directly or after a 482
- Regional employer (494): available, because Perth is a Category 2 regional area
Roles across Western Australia
- Category 3: all of WA outside Perth
- Perth itself is Category 2, so roles across WA can use the 494
- The role must be performed in WA, not just billed from there

FAQ
Questions from Perth clients.
Do we ever need to meet in person?
No. We act for Perth clients entirely by video call, phone and email.
We have lived together for less than 12 months. Can we register in WA?
No. WA has no relationship register. Unless you marry or compelling circumstances apply, you need 12 months of living together before lodging a de facto application.
Can we register in another state instead?
Only if one of you actually lives in that state. Registering somewhere you do not live is not an option.
Our business is in Perth. Can we use the 494?
Yes. Perth is a Category 2 regional area, so the 494 is available for roles based there, with permanent residence through the 191 after 3 years.
Looking for a migration agent in Perth? How is a lawyer different?
Registered migration agents are licensed by the Office of the Migration Agents Registration Authority. Immigration lawyers hold a practising certificate, owe duties to the court and can advise on any area of law that affects your visa. Advice from a lawyer is also covered by legal professional privilege.
Does Form 888 need to be witnessed by a JP in Perth?
No. Since July 2023, Form 888 is a supporting statement, not a statutory declaration, so no JP or other witness is needed. Any adult who knows you as a couple can complete one and attach proof of identity. If you need a Commonwealth statutory declaration for something else, The WA Government lists JPs near you.
General information only, current at 14 October 2026. Not legal advice. Regional areas: Home Affairs postcode list.
